Filming and photography are allowed as described below only to the extent that they do not interfere with the mission of Lincoln County Bookmobile or delivery of bookmobile services. Public library facilities and grounds are defined as limited public forums subject to reasonable time, place, and manner restrictions. The Lincoln County Bookmobile is within rights to limit filming and photography inside facilities when such restrictions serve bookmobile purposes. Foremost of these is ensuring the right of our patrons to acquire knowledge and information freely and confidentially without scrutiny, intimidation, or distraction by others. Consistent with the policies of other public libraries, the Lincoln County Bookmobile may film, photograph, or record sponsored or hosted programs and events at its discretion.
1. Any persons filming, photographing, and/or recording on the bookmobile have sole responsibility for gaining all necessary releases and permissions from persons who are filmed, photographed, or recorded, if applicable.
2. Authorizations may be required to video, photograph, and record at the bookmobile as described below.
3. Failure to obtain these permissions is failure to comply with the Code of Conduct Policy.
Amateur Photography
Casual amateur photography, filming, or recording is permitted at the bookmobile for patrons and visitors wanting a remembrance of their visit, provided that other library users are not captured in any such photographs, films, or recordings with their permission, in accordance with C.R.S. 24-90-119, and Supreme Court decision Katz v. United States, 389 U.S. 347. This held that the Fourth Amendment “protects people, not places” and what a person “seeks to preserve as private, even in an area accessible to the public,” may by constitutionally protected.
News Media Photography
Lincoln County Bookmobile has an open-door policy for news media photographers and reporters who are doing stories or projects that directly involve the Bookmobile and its programs with advanced authorization, which is preferred and can be obtained from the Bookmobile Director. The Lincoln County Bookmobile does not allow the news media to use the bookmobile for stories that do not relate to the bookmobile itself or allow access to patrons for opinion polls or “man on the street” interviews without prior authorization from the director.
Documentary-type Photography for Publication or Broadcast
The Lincoln County Bookmobile permits photography of its facility and activities when the use of the photographs involves the bookmobile directly, such as: books, articles, bookmobile-sponsored events and meetings, videos about the Bookmobile or it services, as part of piece used to describe our community. Individuals or organizations with a documentary requirement must obtain authorization in advance from the director prior to commencing any documentary related activities.
Commercial Photography
The Lincoln County Bookmobile does not permit commercial photography of its facility or events without the written permission of the director. This includes but is not limited to: using the bus for a stage set for portraiture, model photography, or product photography, or filming used to advertise goods or services unrelated to the bookmobile for commercial sale or promotion.
Film Industry
The Lincoln County Bookmobile will permit the use of its facilities for filming-related projects where a bookmobile setting is applicable if the project:
- Does not interfere with the mission of Lincoln County Bookmobile
- Avoids any relation to political campaigns or to partisan issues
- Project is approved by governing authority with all details coordinated in advanced.
- Filming must take place when bookmobile is not serving patrons and is not interfering with staff work
Staff Responsibility
1. Staff may terminate any photo, filming, or recording session that appears to compromise public privacy, safety, or security, or violates a Lincoln County Bookmobile policy.
2. Staff needed to open, secure, or remain on the premises during any event where filming, photographing, or recording occurs will need to arrange scheduling through the library director.
3. Lincoln County Bookmobile engages in photographing, filming, and recording programs and events, on and offsite, for its own marketing and promotional purposes.
- Staff may document any activity on behalf of the Bookmobile, when doing so they must identify their employment and position. Signage will be posted on the bus or program venue about possible photographing, filming, and/or recording.
- Members of the public must immediately notify the staff member if they do not want to be photographed, filmed, and/or recorded. Staff will notify all staff present and involved with documenting the activity of persons not wanting to be photographed, filmed, and/or recorded.
